1. Agreement to Terms

By accessing or using Atiscon (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

These Terms constitute a legally binding agreement between you and Atiscon. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Eligibility

Additionally, you must:

• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Platform under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account. You may register as either a Creator or a Brand. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Types

Creator Accounts: For individuals offering services, content creation, or influencer collaborations.

Brand Accounts: For businesses seeking to hire creators or collaborate with influencers.

4. Platform Services

Atiscon provides a marketplace connecting creators and brands. Our services include:

• Creator portfolio and bio link pages
• Service marketplace for buying/selling creator services
• Project posting and bidding system
• Collaboration request management
• Secure payment processing through Stripe
• Analytics and insights
• Messaging and communication tools

5. Fees and Payments

5.1 Platform Service Fee

We charge a 10% platform service fee on all transactions completed through Atiscon. This fee is calculated as follows:

• Service Price: The amount agreed upon between creator and buyer
• Platform Fee (10%): Our service fee for facilitating the transaction
• Processing Fee: Stripe payment processing fees (approximately 2.9% + $0.30)

5.2 Payment Processing

All payments are processed securely through Stripe. By using our Platform, you agree to Stripe's Terms of Service and Privacy Policy.

5.3 Stripe Connect for Creators

Creators must connect a Stripe account to receive payments. By connecting your Stripe account, you authorize us to facilitate payments on your behalf.

5.4 Payment Timeline

Payments are held in escrow until the buyer marks the order as complete. After completion:

• Buyer has a 15-day dispute period
• If no dispute is filed, funds are automatically released to the creator
• Payments are transferred to the creator's Stripe account within 2-7 business days

6. Refunds and Cancellations

6.1 Refund Policy

Buyers may request a refund under the following conditions:

• The creator fails to deliver within the agreed timeframe
• The delivered work significantly differs from what was agreed upon
• The creator violates our Terms of Service
• Other valid disputes approved by our admin team

6.2 Refund Process

When a refund is approved:

• Stripe processing fees are non-refundable and will be deducted from the refund amount
• The 10% platform service fee will be refunded to the buyer
• The buyer receives: Original Amount - Stripe Fees

6.3 Dispute Resolution

Disputes are reviewed by our admin team within 3-5 business days. Both parties will have an opportunity to present their case.

6.4 No Refunds After 15 Days

Once the 15-day dispute period expires after order completion, refunds are no longer available unless there are extraordinary circumstances.

7. User Conduct and Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Attempt to bypass our payment system
• Use automated systems (bots) without permission
• Upload malicious code or viruses
• Impersonate others or create fake accounts
• Engage in money laundering or fraudulent transactions
• Spam or send unsolicited messages

8. Intellectual Property

8.1 Platform Content

The Atiscon platform, including its design, features, and content, is owned by us and protected by copyright, trademark, and other laws.

8.2 User Content

You retain all rights to content you upload. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform.

8.3 Copyright Infringement

We respect intellectual property rights. If you believe content on our Platform infringes your copyright, please contact us at support@atiscon.com.

9. Data Collection and Privacy

We collect and process personal data as described in our Privacy Policy. Key points:

• We collect information you provide during registration and use
• We collect analytics data (IP address, device info, usage patterns)
• We do NOT share your personal data with third parties for marketing purposes
• We use Stripe for payment processing (subject to Stripe's privacy policy)
• We may share data with law enforcement if required by law

10. Disclaimers and Limitation of Liability

10.1 Platform "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

10.2 No Guarantee of Results

We do not guarantee:

• That creators will find work or earn income
• That brands will find suitable creators
• The quality of services provided by creators
• Uninterrupted or error-free service

10.3 User Responsibility

You are solely responsible for:

• Your interactions with other users
• The quality of services you provide or receive
• Compliance with tax obligations
• Your own content and intellectual property rights

10.4 Limitation of Liability

To the maximum extent permitted by law, Atiscon shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

11. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Any reason we deem necessary to protect the Platform or other users

You may terminate your account at any time through your account settings or by contacting us.

Upon termination:

• You lose access to the Platform
• Pending payments may be withheld pending review
• Your data may be retained for legal/compliance purposes

12. Governing Law and Disputes

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Nantes, France.

Before initiating legal action, you agree to attempt to resolve disputes through good faith negotiations.

13. Changes to Terms

We may update these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• We may notify you via email or platform notification
• Your continued use constitutes acceptance of the new Terms
